The Case For We The People & “The Preponderance Of The Evidence”…

I’m throwing down a radical notion here — a way for We The People to get back what was STOLEN from us — the outcome of Election 2016 that we voted for.

If the Rule Of Law is a “thing” then Donald Trump cannot be POTUS — not the legitimate POTUS. The Rule Of Law says very clearly that you cannot CHEAT and “become POTUS”. If you CHEAT, it DISQUALIFIES your run. You cannot therefore, by definition, “WIN”.

Cheaters cannot “win” — not if the Rule Of Law is operating at full 100% functionality. Therefore, if we accept that 1) Donald Trump & the GOP CHEATED — in ways profoundly ILLEGAL — in order to win election 2016, then 2) Donald Trump & the GOP did not “WIN” election 2016. Their “win” never happened. They STOLE the actual outcome — not in some abstract way — but LITERALLY — from us — from WE THE PEOPLE.

The result we voted for — a more progressive America — was not only denied us, but it’s diametric opposite was, instead, forced down our throats by the very people WHO’D STOLEN THE TRUE RESULT. When someone steals your car — and they catch him — they make him GIVE THE CAR BACK. Because it’s not his — and never was his.

The results of an election can be no different. Just as you cannot reward a car thief with the thing he stole, you cannot reward ELECTION THIEVES with the thing THEY stole — the election’s actual outcome. Even voting them out doesn’t solve the problem because the results of the previous stolen election continue to bear the stolen election’s fruit: legislation the electorate DID NOT WANT and JUDGES the electorate would NEVER have approved of. The will of the people is being violated willfully and repeatedly.

We The People have skin in this game and a dog in the hunt. Legally speaking, we have “standing” to sue Donald Trump & the Republican Party in a CIVIL COURT for damages because they violated our electoral will and STOLE the desired outcome of an American election.

This description of “preponderance of evidence” comes from the Cornell University Law School’s web site: “Preponderance of the evidence is one type of evidentiary standard used in a burden of proof analysis. Under the preponderance standard, the burden of proof is met when the party with the burden convinces the fact finder that there is a greater than 50% chance that the claim is true. This is the burden of proof in a civil trial.

That’s my radical idea. We The People sue Trump & the GOP in civil court. We sue em for a buck cos it ain’t about the money. It’s about getting to the Truth about what they’ve done and what they’ve done TO us. In a civil trial, our burden would be 50% — get past 50% and we win our point and win our case.

Even our gun shy press might catch on (finally) that the smoking gun needed to prove (in a court of civil law) that Trump and the GOP are corrupt to their marrow and traitors on top of it is actually a smoking preponderance of evidence.

Again — the point isn’t money (hell, we’ll go after Trump & every stinking, corrupt Republican separately) — it’s getting back our stolen car. In our case, our stolen election results.

We could use the civil process to leverage our way into the criminal process — by using the civil process (and its discovery) to reveal the full extent of the crime. Having brought vital evidence out into the open, We The People can turn it all over to the criminal courts for prosecution and disposal. Think we the people can’t clear the 50% preponderance hurdle?

Have you read ANY of the evidence we already have? Imagine how easy this will be when we start getting ahold of all the stuff Trump & the Republicans have been clutching to their chests so fearfully.

President Obama was absolutely right when he said — as he left office — that no one would come to save us from this shitshow except us. We The People need to step up right now. We need to see the evidence we already have — understand what it means — and react. Even before the trial gets up to speed, the preponderance of the evidence buries Trump and the Republicans in tons of criminal behavior.

We need to step up and pull the trigger on prosecuting them all. We owe it to ourselves.

My Sexual Assault Survivor Spidey Senses Are Tingling Like Crazy: What The GOP Is Doing To America Is Exactly Like A Sexual Assault

No one really “recovers” from being sexually assaulted. You can live with it, of course. You can make a kind of uneasy peace with it. But you can never accept that it happened to you.

The disease that comes with being sexually assaulted is believing that you deserved it. That’s what keeps you silent. In my case, I kept it so silent that I almost forgot WHY I had come to believe later in life that every bad thing that happened to me was my fault. I still believed then that being sexually assaulted was my fault.

It wasn’t of course. I was 14. The man who assaulted me — twice — was the religious director at the synagogue where my family belonged. The only thing I did “wrong” was not report him after he assaulted me that first time. But, like lots of victims, I began to question myself. I even questioned whether the assault had actually happened. It was surreal — a grown man rubbing his erect penis between my ass cheeks — through our clothes (he kept his underpants on, ya could say!) while supposedly coaching me on how to perform a haftorah at a Saturday morning Shabbat service. How could those two things go together?

I said nothing after it. That meant that when it happened again to me — when I again allowed myself to be in the same place at the same time as my sexual assaulter — all alone with him — it must have been my fault. Yehuda (that was his first name — he’s died since) knew that I hadn’t told anyone. He wasn’t in jail.

And since I was back — it obviously meant I’d say nothing this time too. I’d keep our secret. The moment that second sexual assault began, I was done. I was deep in both a hurt locker & a self-blame locker. Self-loathing was a natural outgrowth. Mine came within literal inches of killing me.

In getting better — and I am getting better — I have learned that it’s important to see things for what they REALLY are. Yehuda was a criminal perpetrating a crime upon 14 year old me. I was both a victim of sexual assault and a survivor. I have carried the scars with me since it happened. That’s over 45 years. I think we can safely say now that my sexual assault is part of my architecture.

I know with terrible certainty what those feelings are — when that pricking starts on the back of your neck. What I wake up feeling every day — even more so while the Senate Republicans sexually assault the Truth with abandon — is exactly what I felt the second time Yehuda stood behind me and rubbed his erect adult penis between my 14 year old ass cheeks. We are being assaulted.

Sexual assault isn’t “sex” the same way rape isn’t “sex”. It’s a crime of violence committed using sexual means. It’s a man using his penis as a weapon. It’s about power — his over you.

That is exactly what the whole Republican Party is doing to America, to The Rule Of Law, to the Constitution and to every single American who voted against this — in other words THE MAJORITY OF AMERICANS.

Don’t give that Electoral College nonsense. Yeah, yeah — Trump, the GOP & Russia gamed our system perfectly. They even told us (focus on PA/WI/MI) to win. Not because they intended to win more votes there but because they knew Russia was going to cheat in every way it possibly could for their benefit.

Why don’t Republicans want the truth to be told? Puh-lease! Because the Truth is, the Republican Party has its pants down around its ankles. It’s got its dick in its hands and is actively trying to force it on us. We keep saying “NO!” and they keep ignoring that fact.

They keep forcing Republican policies they KNOW the majority doesn’t want just like a rapist forcing his flesh into an unwilling victim’s. No means no means NO.

Rapists and sexual assaulters don’t stop being rapists and sexual assaulters just because they can’t rape and sexually assault people 24/7. They have to eat & sleep. They have to pay the rent. But a rapist eating and sleeping — going to his job — is still a rapist. He dreams of rape. He craves rape. Rape is how he solves all his problems.

A rapist feels entitled to rape people.

Just like Republicans feel entitled to cheat Americans from what THEY voted for — and force THEIR awfulness where it ain’t wanted.

Integrity Is An All Or Nothing Proposition

Nothing is funnier than a Republican drawing himself up, having just been asked a serious question about his integrity. He knits his brows, purses his lips and goes all “earnest” with his voice.

Mitch McConnell talking “patriotism” — having just lifted the sanctions punishing Oleg Deripaska for changing the outcome of election 2016, say. That’d be Mitch insisting he’d done something great for the people of Kentucky (while betraying them and everyone else in the country).

Your average Republican thinks THAT’S “Integrity”. Acting like you have it.

When you have no integrity, acting like you have it is as close to having integrity as you’re ever going to get.

What Republicans especially don’t seem to grasp — integrity while iron-clad at its core, is built of gossamer. It’s a soap bubble, easily punctured. And just like a soap bubble, once popped? It’s popped for good.

There’s a reason we don’t say things like “Ya know, that Kevin McCarthy — the GOP Leader — he may not have all his integrity, but 70%’s okay with me!” The moment Kevin slipped below 100%, that should have been the end of it. How can you trust someone almost completely but not completely? That means you DON’T trust them because even when you do, you really don’t.

That’s how integrity works. It is or it isn’t.

Can we all please, please, PLEASE agree? When it comes to integrity, if you still have an “R” next to your name? While Donald Trump’s a Republican? If you stand in any way, shape or form with him?

You can’t even spell “integrity”.

The Problem With Coming Late To The Party

Think back to election night 2016.  I bet you can still recall that sick feeling in the pit of your stomach when it hit you that the impossible – Trump “winning” the presidency – had just happened.  Some of us saw that sick feeling as more than just disgust at a bad election result.  It was our noses catching the scent of corruption. 

Trump “winning” wasn’t just a bad election result, it was bullshit.  Literal bullshit.  Even Trump knew it that night – it was well reported how surprised everyone was in the Trump campaign.  It wasn’t the “unlikeliness” of the result that shocked them, it was the fact that the crime they were all part of had just succeeded beyond any of their wildest imaginations. And in spite of their efforts.

Even during the campaign, Trump’s relationship with Russia was under the microscope.  Remember Trump telling Hillary that she was Putin’s puppet, not him?  Pretty funny, that moment, if you think about.  Not so much funny “ha-ha” as funny “boy, does that stink!”.  Turns out we were witnessing something profound.  Trump was projecting as Trump does.

He was confessing: he was Putin’s puppet.

Let’s be quite clear – between then and now, Trump being Putin’s puppet has not become “less true”, it’s become “more true” and by “more true”, I mean “more painfully obvious”.  What used to sound – and be called “hyperbolic” – Donald Trump is a traitor – is now openly stated on relatively reliable news channels like CNN & MSNBC.  If we get to play this all out – I believe we will – and proof of Trump’s treason finds the light (more than it already has – ample proof having already found plenty of light), it won’t mean Trump started being a traitor at the moment we collectively decided he was guilty of it.

It will only mean we’re finally calling Trump the thing he is: a traitor.  He’s been a traitor all along.  He’s been betraying us all along – even when we refused to think he was a “traitor”.  He was being one. 

We all know what happens when you arrive late to a party.  The food’s pretty much gone.  So’s the best wine and the best beer.  Being late gets you the dregs of everything. The news works exactly the same way.

The American News Media has been behind from day one with this story. Between normalcy bias and failure of imagination, they’ve consistently failed to see the enormity of Trumps crime in real time — even as he was committing those crimes in plain view, right in the Main Stream Media’s face. They’re just beginning to see it, get it and report it now.

That’s great that they’re catching up. Great that they see a real and viable threat here. But it doesn’t change the fact that it took the Main Stream Media this long to figure out how much they didn’t know.
